Trucking Accidents

Collisions with large tractor-trailers cause many injuries and deaths each year on our nation’s highways. Semi-trucks (“18 wheelers,” “big rigs”) are so large and heavy that drivers and passengers of sedans, and even SUVs can be at a great disadvantage on the road. Trucks can weigh over 10,000 pounds, compared to a typical sedan weight of 2,000-3,000 pounds.

Some causes of trucking accidents include: high bumper height or lack of bumpers on tractor trailers (which can lead to underride accidents), truck speeding, aggressive driving, jackknifing, unsafe lane changes and maneuvers, truck driver fatigue, truck driver drug and alcohol abuse, and unsafe trucks or truck parts (poor maintenance).

The Federal Motor Carrier Safety Administration (FMCSA), part of the Department of Transportation, sets Hours of Service regulations for truck drivers. These rules are intended to promote safety by restricting the number of hours a truck driver may drive without rest, the number of consecutive days a truck driver may drive, and other factors. In an effort to achieve higher profits, many trucking and shipping companies violate these regulations. If you or a loved one were injured in an accident with a big rig, Ashkin Law will investigate the accident to determine the best avenue to financial recovery.

Premises & Workplace Liability

Property owners, including private and commercial owners, are generally required under the law to maintain their properties in a safe and secure manner for those who frequent, are invited into, or are otherwise appropriately on the property site. Failing to maintain the property site in a legally safe and secure manner may create a legal responsibility to those who are injured on these premises as a direct result of such failures.

Persons injured resulting from falls on defective floors, stairs, and other conditions are among the myriad reasons which may result in a legally compensable claim. Exposure to toxic substances resulting in injury, such as lead paint and pesticides, may also create a legal obligation.

Another frequent and serious violation of owner-related negligence is the failure to implement and maintain security devices in the building to insure against untoward intruders who may assault, victimize, or rape those legally upon the site.

These owners are often responsible as well for the sidewalks fronting their properties. Uneven, cracked and/or displaced sidewalks in disrepair cause countless injuries to unsuspecting passers-by, and these owners can be held accountable under the law for their negligence and inaction.

Each of these areas of negligence are dictated by stringent time periods under the law, so if there has been such an incident experienced by you or a family member, immediate legal consultation is imperative. The Ashkin Law Firm individually addresses these claims and ensures the personal privacy, compassion, and aggressive legal attention these very special cases require.

Nursing Home Abuse

One of the most vulnerable groups of patients, nursing care residents, often needlessly suffer at the hands of those in whom we place our greatest trust. Bed sores (or decubitous ulcerations), which can lead to aggressive and often deadly infections, are a common and often avoidable consequence of nursing and medical malfeasance in these settings. Other common abuses include fractures from bedside and other falls, elopement or wandering away from the facility, malnutrition, dehydration, verbal and psychological abuse and even sexual abuse.

Fortunately, the law does provide compensable legal remedies for nursing home patients, elderly patients, mentally incompetent patients and others who require management in skilled nursing facilities.

Children’s Safety

Children are at increased risk because of their inability to identify dangers and take effective actions to avoid them. Preventing child injuries is rooted in limiting their exposure to hazardous conditions and products. Of course, children are often victimized by products and environments specifically designed for their use. Oftentimes children’s toys, clothing, sporting and recreational facilities such as playgrounds and pools, and even protective devices such as child car seats, are found to have been defectively designed, causing otherwise avoidable harm and injury.

If your child has been injured under any one of these numerous scenarios, it is imperative that you seek legal consultation on hos/her behalf immediately. While many states provide special considerations for parents or guardians bringing claims on behalf of their injured or maimed children, there are stringent time restrictions which could seriously impact upon your ability to seek full compensation.
